Overseas Customers: If you are an overseas (non-Australian) customer, you expressly agree that Australian law (in particular, the law of New South Wales) will govern all aspects of your use of our site and any purchases you make. By purchasing our goods or using our services, you agree that any dispute or claim will be brought in our nominated jurisdiction (New South Wales, Australia) and decided under its laws. Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that provision or any other provisions.

4. Shipping and Delivery
International Shipping: De Lumen offers worldwide shipping. We dispatch orders from Australia to various international destinations. Shipping options and applicable fees will be presented at checkout. We strive to deliver your products as quickly and safely as possible. Note that some products may be subject to import restrictions or regulations in certain countries; by placing an order, you represent that the products can be lawfully imported into your country.
Delivery Timeframes: Estimated delivery times will be provided when you place an order (usually at checkout or in the shipping information section). These timeframes are estimates only and are to be used as general guidelines, not guarantees. Actual delivery times may vary based on your location, chosen shipping method, and other factors. We will make reasonable efforts to meet the estimated delivery times, but we are not responsible for delays due to circumstances beyond our control (e.g. postal/courier delays, customs processing, natural disasters, or other unforeseen events).
Customs Duties & Taxes: International shipments may be subject to import duties, taxes, or other fees levied by the destination country’s authorities. Any such customs duties, import taxes, or fees are the responsibility of the recipient (customer). These charges are not included in our product prices or shipping fees. We have no control over these charges and cannot predict their amount – they vary widely by country. If you are unsure about the import fees in your country, please check with your local customs office before ordering. You as the customer are considered the importer of record and must comply with all laws and regulations of the destination country. If customs clearance procedures are required, they can cause delays beyond our original delivery estimates.
Shipping Process and Tracking: Once your order is processed and dispatched, we will provide a shipment confirmation email. This email typically includes tracking information so you can monitor the progress of your delivery (if tracking is available for your selected shipping method). Please ensure the shipping address you provide is correct and accessible; we are not responsible for shipments lost or delayed due to incomplete or incorrect addresses provided by the customer.
Risk and Title: Title to, and risk of loss for, the products you order passes to you upon delivery of the goods to the address specified in your order. If a package is lost or damaged in transit, please contact us so we can assist in resolving the issue with the courier. We may help facilitate a claim with the carrier or provide a replacement or refund as appropriate, in line with our obligations and any shipping insurance in place.
Delivery Issues: If your order does not arrive within the expected timeframe, or arrives with obvious damage, please notify us as soon as possible. We will work with you to investigate the issue. For damaged items, we may ask for photos of the damage to help resolve claims with the carrier. We aim to resolve shipping problems promptly to your satisfaction where possible.
5. Refunds and Returns
ACL Compliance: De Lumen handles returns and refunds in strict accordance with the Australian Consumer Law (ACL) and relevant consumer protection regulations. Nothing in our refund policy is intended to limit or exclude the consumer guarantees and rights you have under the ACL. In Australia, products and services come with guarantees that cannot be excluded – for example, that goods are of acceptable quality and match their description. If we fail to meet a consumer guarantee, you are entitled to a remedy under the ACL (such as a repair, replacement, or refund) depending on the nature of the failure.
Change of Mind: Please choose carefully when making a purchase, as we generally do not offer refunds or returns if you simply change your mind or decide you no longer want the product. Due to the nature of international e-commerce, returning items can be costly and time-consuming; therefore, change-of-mind returns are not covered by our standard policy (except where we voluntarily offer it for certain products or promotions, which would be clearly indicated). This does not affect your ability to cancel an order before it ships (see Order Cancellations below).
Eligible Returns (Faulty or Misdescribed Goods): You are entitled to a refund, exchange, or repair if the products you purchased from De Lumen meet any of the following conditions:
· Damaged or Faulty: The item is defective, malfunctions, or is damaged upon arrival (through no fault of your own).
· Not as Described or Significantly Different: The product received is significantly different from its description or images on our website (e.g., wrong item shipped, missing crucial features that were advertised).
· Unfit for Purpose: The product isn’t doing what it’s supposed to do, or what a reasonable consumer would expect it to do, and cannot be easily made to do so.
These scenarios align with your rights under the ACL, which entitle you to remedies if a product fails to meet consumer guarantees. If you believe your situation meets one of the above criteria, please contact our customer service within a reasonable time (ideally within 7 days of receiving the product, or as soon as you notice the issue) to inform us of the problem. We will then assess your claim and advise you on the next steps.
Process for Returns/Refunds: To initiate a return or refund for a faulty/misdescribed item, reach out to us via our support email or contact form with your order details and a description of the issue. We may request evidence of the problem (such as photographs of a defect or damage, or a description of how the product is not as described). We may also require proof of purchase (like your order number or receipt) to process the claim. If a return is deemed necessary, we will provide you with return instructions, including the return address. When returning an item, please, if possible, send it back in the original packaging with all contents – this helps us assess the issue and process the return more quickly (though we will not refuse a remedy solely because the original packaging is missing, if the lack of packaging does not prevent us from verifying the problem).
Depending on the circumstances, and in line with the ACL:
· For minor issues, we may offer a replacement or repair of the product if feasible.
· For major issues (a problem that cannot be fixed or is too significant), you are entitled to choose a refund, replacement, or in some cases, compensation.
We will work with you to determine the appropriate remedy. If a refund is approved, we will process it via the original payment method where possible. If an exchange or replacement is arranged, we will ship the new item to you at no additional cost.
Return Shipping Costs: If a product is confirmed to be faulty or not as described, we will generally cover or reimburse the reasonable return shipping costs for sending the item back to us (or we may provide a prepaid return label when available). If the return is not due to our error or a breach of consumer guarantees (for example, if we exceptionally allow a change-of-mind return), then you may be responsible for the shipping cost of returning the item. We will inform you of the situation during the return process.
No Limitation of Statutory Rights: This Refunds and Returns policy does not exclude or replace any rights or remedies you have under Australian law. In summary, we will provide refunds, replacements, or repairs strictly as required by the ACL and other applicable laws. Outside of those requirements, any additional refunds or exchanges are at our discretion. If you have any questions about your eligibility for a return or refund, please contact us – we are committed to honest and fair business practices in compliance with consumer protection laws.
Order Cancellations: If you wish to cancel your order, please contact us before your order has been dispatched. We process orders quickly, so if you need to cancel, do so as soon as possible. If your cancellation request is received before the order is shipped, we will typically cancel the order and issue a full refund of the purchase price. However, if the order has already been processed and handed over to the courier, cancellation may not be possible (in that case, you might need to proceed with a return instead, if eligible). We reserve the right to charge a reasonable cancellation fee to cover any non-recoverable costs (such as payment processing fees) incurred by us, especially in cases of last-minute cancellations, but we will inform you if any fee applies. No cancellation fee will apply if the cancellation is due to our inability to supply the goods or some fault on our end.
6. Liability Disclaimer
No Limitation of ACL Rights: Nothing in these Terms and Conditions limits or excludes any guarantees, warranties, or conditions implied or imposed by law that cannot be limited or excluded, including your rights under the Australian Consumer Law. This means we do not seek to exclude our liability for any matter that we cannot by law exclude. Your statutory rights as a consumer (such as rights relating to faulty or misdescribed products) remain fully in force and are not diminished by anything in these Terms.
Website Use “As Is”: Except as set out in the above paragraph and to the maximum extent permitted by law, use of the De Lumen website and our services is at your own risk. The website and all content, information, and services provided through it are supplied “as is” and “as available” without any warranty or guarantee of any kind, express or implied.
